2016年经济师考试的备考已开始起航，<a href="http://gxhqwx.soxsok.com/" target="_blank">环球网校经济师</a>小编特整理中级经济师建筑专业备考知识点，希望对您备考经济师也有一定的帮助！ 索赔程序 我国关于《建设工程施工合同（示范文本）》通用的条款中规定，当一方向另一方提出了索赔时，要有正当的索赔的理由，且有索赔的事件发生时的有效证据。示范文本中规定了承包人向发包人提出索赔、发包人向承包人提出了索赔的程序。以承包人向发包人提出的索赔程序为例，发包人未能按合同约定履行自己的各项义务或发生错误以及应由发包人承担责任的其他情况，造成工期延误和（或）承包人不能及时得到合同价款及承包人的其他经济损失，承包人可按下列程序以书面形式向发包人索赔。 （1）发出索賠意向通知。索赔事件发生后，承包人应在索赔的事件发生后的28天内向工程师递交索赔意向通知，声明将对此事件提出了索赔。该意向通知是承包人就具体的索赔的事件向工程师和发包人表示的索赔愿望和要求。如果超过了这个期限，工程师和发包人是有权拒绝承包人的索赔要求的。索赔事件发生后，承包人有义务做好现场的施工的同期纪录，工程师有权的随时检查和调阅，以判断索赔的事件造成的实际损害。 （2）递交索赔报告。发出索赔的意向通知后28天内，或工程师可能同意的其他的合理时间，承包人应递交正式的索赔报告。索赔报吿的内容应包括：事件发生的原因，对其权益影响的证据资料，索赔的依据，此项索赔要求延长工期和（或）补偿经济损失的详细计算等有关材料。 如果索赔事件的影响持续存在，28天内还不能算出索赔额和工期展越天数时，承包人应按工程师合理要求的时间间隔（一般为28天），定期陆续报出每一个时间段内的索赔证据资料和索赔要求。在该索赔事件的影响结束后的28天内，提出较终详细报告及索赔论证资料和'累计赔偿额。 承包人发出索赔的意向通知后，可以在工程师指示的其他合理时间内再报送正式索赔报告。工程师在索赔事件发生后有不立即处理该项索赔的权力。如果事件发生时，现场的施工特别紧张，工程师不希望分散各方抓紧施工的管理的精力而立即处理索赔，可通知承包人将索赔的处理留待施工不太紧张的时候再去解决。但承包人的索赔的意向通知必须在事件发生后的28天内提出，包括对变更估价的双方不能取得一致的意见，而先按工程师单方面的决定的单价或价格执行时，承包人提出的保留索赔的权利的意向通知。如果承包人未能按规定时间提出索赔意向和索赔报告，则他就失去了对就该项事件请求补偿的索赔权利。此时他所受到损害的补偿，将不超过工程师认为应主动给予的补偿额。 <a href="http://gxhqwx.soxsok.com/" target="_blank">环球网校经济师</a>小编温馨提示：如果您对上面的内容有疑问或者想了解更多关于经济师的相关信息，请登录到<a href="http://gxhqwx.soxsok.com/" target="_blank">环球网校经济师</a>频道。<a href="http://gxhqwx.soxsok.com/" target="_blank">环球网校经济师</a>小编会在时间为各位考生更新相关考试内容，请大家继续关注<a href="http://gxhqwx.soxsok.com/" target="_blank">环球网校经济师</a>以便随时掌握相关动态！ <a href="http://gxhqwx.soxsok.com/" target="_blank">环球网校经济师：http://gxhqwx.soxsok.com/</a>
